I see your point in
terms of damages.
However, but from a duty to report standard - as I understand Title IX (and I'm not an expert) - if an employee knows of another employee's transgressions they are required to tell superiors, similar to an honor code.
Doesn't mean someone else gets damages because they didn't - but can impact the future employment of those that failed to report.
