Oh I dont think it will go that high up
You are right that courts will not want to hear it but many state governments and representatives will 'threaten' to go that route and then settle in a deal that makes them look good. The thing with 88 is you have to have enough schools in - more than half or the majority will out vote you. A set up with 64 is just a few teams under the half way mark.
I am not sure the ICC can be stretched that much even though it gets stretched over a lot of things. There would actually be no physical product transacted to classify.
