You are also a bit unaware of contract workings. This article actually lays out a discussion on the activation of a term. If the Big-12 expanded with schools not from the P5 membership, both Fox and ESPN cried fowl because they would be forced by contract to pay more for those teams. It was a term that the Big-12 could activate if they wanted too. The Big-12 chose not to activate that term and both ESPN and Fox relaxed. That clause no longer exists in the contract. Why? Because ESPN agreed that the re-negotiated contract is for 10 tens and any addition would be paid for on a case-by-case basis:
