Congress has to set the parameters


If the conferences or NCAA try to set the parameters, it is a violation of anti-trust regulations. Any limits on compensation set by a group is a violation unless it is part of a Collective Bargaining Agreement, that's why the NFL, MLS, NHL, NBA, MLB and minor pro leagues are able to have compensation limits, and unless they can get all the college athletes to join the union and then have that union agree to a CBA, then they need Congress set the parameters.
