ND will remain indy unless 1 or both of these events occurs

1. ND gets shut out of the CFP multiple times. There are still old school ND folk (e.g. TerryD) that would chalk it up to the cost of doing business and still remain independent. This group supposedly wields a great deal of financial power in the donor base, so there is a great deal of inertia for the status quo to endure.
2. The Big12 collapses. If the Big12 does collapse, then the ACC could issue the ultimatum and hope that ND would rather go all in with the ACC than send their non football sports to the Big East. If the ACC gave ND an ultimatum while the Big12 still exists in its current form, they would just hitch their wagon to the Big12 in a partial membership. The Big12 offered it before and would offer it again. If the Big12 also insisted on full membership, then ND could either join the Big East in non-football or go all in with the ACC (assuming they prefer the ACC over the Big12, which seems to be the case).
