I think expansion comes first, then they leave...

The reason has been used before: "This isn't the same conference we've been a part of for so many years."

As long as they can show they tried to make it work and are leaving the Big 12 with an adequate number of membership so as to not completely ruin the conference, then there most likely won't be too much of a case to hold them back.
