I tend to agree with Lot11, and here is why


If you take an action whose reasonable and expected outcome is for someone to die...whether that was your plan or not...that should be considered murder. Agree it wouldn't meet the premeditation requirement for Capital Murder or Murder 1, but I still think it puts you on a higher order than just Manslaughter (which is basically, ooops, they're dead, my bad).

Try this corollary: Imagine pulling the pin and rolling a hand grenade across a highway. Whether or not you intend to kill anyone is secondary to the complete disregard for the safety of others. You are still channeling an incredible amount of destructive, uncontrolled kinetic energy into a crowd. You don't get to act surprised if it hurts someone.

Is the impaired operation of a 3000# vehicle at 60 MPH really all that different? Do we not literally have examples every day of this causing property damage, injuries, and deaths?
