I would think they could break away and just close off membership.


It would be like a conference. The ACC is closed to new members unless they one day decide to consider expanding, then they have the freedom to extend an invitation to whomever they choose. They may want to set up some requirements that current members need to maintain or risk being expelled. But, I don't think they would want other schools to be able to say, "we meet your requirements, now you have to let us in". When/If they break away, it will be different from IA and IAA, where you have to meet certain requirements in order to move up. They will be forming greater separation, and there will not be room for some school to choose to move up. It will be far more exclusive than the separation from IA and IAA (FCS and FBS). The P5/4 won't be looking to form a new level, they will be breaking away and forming their own identity. The justification for inclusion or exclusion would be based on the fact that certain conferences are breaking away, if you are not part of these conferences then you are excluded. And there will be lawsuits. At least that is what I understand would be happening
