I can't believe that Title IX would be invoked by a coach's spouse
Title IX is intended to protect athletes and the integrity of athletics. The reporting requirement is intended to ensure shady coaches are removed from the realm of college athletics. Maybe Title IX was written strangely, and experts can comment here, but I cannot imagine what theory of recovery a battered spouse could have.
A battered spouse should not rely on a Title IX provision to be invoked in order to stop abuse. That's what 911 is for. Unless she has some backdoor theory as a third party beneficiary of the Title IX reporting requirement, I do not see a case. OSU may have been negligent, but they are not liable for all possible damages flowing from that negligence.
Further, how can she argue she would have been better off if her husband was reported? It could have been worse for her - probably would have been. She can avoid the problem in either case by getting away.
I expect she'll get paid, but it won't be kosher imo. Everybody will ask "why didn't you leave him?", and she'll say "I was hoping OSU would fire him!". LOL>
