The driver is always sued, the insurance company covers the
judgement less the deductible and all. The issue is if the judgement is more than the amount of insurance the driver has, then it is on the driver. I was in a multi car rear ender and the guy who hit the three of us (rear ending the guy behind me shoving me into a pickup in front of me) his insurance person told me the driver may not have enough insurance to cover the damage to all the vehicles, much less any money for a rental car. It was not worth it to go after the guy as he did not have a pot to urinate in.
