Of course, Scalia "left" and wasn't replaced under that president, so I'm


not sure the old rules/norms will still apply in the future. It's going to be a mess going forward when the President is from one party and the Senate is controlled by the other (then again, we could see some attempts at court packing when the Senate and President are aligned as well).

Surely the confirmation of the new Justice will come after November, so that the voters can have their input on the Senators that will confirm the nominee (yes, that is fully TIC).
