Response from VA State Police on HOV enforcement

The tolls will be enforced using the same techniques as we currently use on I-95 & I-495.  Each toll gantry has a series of lights positioned over each lane.  When a vehicle with an EZ-Pass Flex set to the HOV mode passes under the gantry a light over the lane flashes.  Troopers stationed just downstream from the gantry then look to see how many occupants are in the vehicle.  Single occupant vehicles with the EZ-Pass in the HOV mode will be issued summonses.  The fines parallel the HOV fines, 125.00 for a first offense and doubling for each subsequent offense up to 1,000.00 for a fourth offense.  The minimum patrol staffing on I-66 on weekdays has been doubled to assure prompt incident response and strict enforcement of the tolls.  Obviously we don’t have enough resources to catch every violator, but we will be aggressively enforcing compliance with regard to use of the EZ-Pass Flex.  I hope this addresses your concerns.
