The problem they have is he was not involved in the actual crime

He may have had someone do it but first they have to find the people that actually did it and get them to flip on McCoy. That will be difficult to get there I would think. Domestic stuff is never pretty, this situation seems very nasty as he owns the home and is trying to get her evicted from it and she refuses to leave.
