Shouldn't have been driving on Susp Lic (especially @ 3am)

But failure to yield/stop, coming out of a gas station and/or shopping complex?

Unless it was blatantly dangerous (like almost causing an accident) -- I'd guess the police can yank anybody for that, at any time of the day. One of those vague violations that can be enforced at whim.
