will sell both Whoppers and Big Macs, Wendy's isn't offered at all. And since you have the misfortune of living in a city served by BurgerMart, you can't get Wendy's. But the next town over, who doesn't have BurgerMart but instead has BurgersRUs, has a preferred contract with Wendy's but no agreement with McDonalds.

And no town ever has both BurgerMart and BurgersRUs.


To get away from silly analogies, the fall of net neutrality wouldn't bother me at all if most of the country actually had a choice when it comes to ISP. Even if the law didn't force companies to not throttle 3rd party content, free market competition would. Except there is no free market competition. Everywhere I've ever lived had a grand whopping total of one option for high speed internet service. You'll take it and you'll like it.

A possible solution to this mess could be forcing ISP's to lease their hardware to 3rd party providers, much the same way the FCC forced AT&T to lease their hardware to competing phone companies after the breakup. We didn't need phone neutrality rules back then because AT&T, Sprint, MCI, and a host of smaller players were fighting tooth and nail for people's business. If any one of them tried some draconian customer service tactic, the marketplace would have destroyed them.
