So, the only issue is the $3500?

you co-signed on his credit card so you had to deal with that. He's on your insurance so the bills are going to come to you anyway, and you're legally required to pay it, but, it's insurance so you're not paying the entire bill and maybe can deduct it if its large enough on your taxes.

You're not obligated to pay his taxes, right? The probate court would have to name you as the executor. I'm not a lawyer but why can't you just fill out some form to petition to be the executor or show up on the day of probate and say "I'm the closest relative" and if they deny you...so what? at worst you'll lose $3500. And, as you mentioned, the economic analysis is $3500 versus the cost of a lawyer. Can you get the lawyer for under $3500? I doubt it, at best it would be a wash.

You're kinda doing the court a favor here, and the judge should recognize that. If they want to deal with the pieces, fine. Suppose some creditor walks in with bill for $10k? I wouldn't pay it, he was an adult, remember? Let them do the work, if they're making it hard for you to take it over.
