Are you still getting severance? If so I would not have even returned the call/email. It would be fairly easy for your former employer to STOP paying you severance if they feel like you've violated the non-solicitation/non-hire, then it would be incumbent upon YOU to prove that you hadn't.

If you're no longer receiving any benefit from the former employer, I think there's much less risk. They would have to come after you for damages and it would be incumbent upon THEM to prove you had violated those clauses. Probably not worth their time unless you did it repeatedly, and even then you'd probably get a "cease & desist" before they actually tried to sue you. Of course there is some risk, but much less in this scenario IMO.
