Storm water drain question


My brother has an old 30 inch diameter storm water drain in his yard. It is an old pipe and is collapsing in on itself and is causing problems in his yard. He has spoken with the developer of the neighborhood, VDOT (who used to be in charge of the storm water drains in this city), and city council. City council said they will not pay for it to be taken out and filled in with dirt. They are asking him to prove that it is their pipe. He asked for the old blue print of the neighborhood with all of the utilities but they are saying it is lost.
Any suggestions on what to do here?
