The correspondence I've seen from him definitely had a "WTF did I do?" tone to them, which is totally understandable given he got mandated counseling and a suspension simply for asking questions.

Re the items that got thrown out of the lawsuit, those were for procedural issues. He alleged a conspiracy, but a single business or public entity is incapable of a conspiracy since it requires multiple parties, and something like a university is considered to be a single entity by law. His allegation of no due process was thrown out because he had 5 days to appeal his expulsion (which he did, and got denied), and 3 hours notice of the hearing to decided his fate. It may have been a kangaroo court, but there was at least the façade of due process there. The damages were thrown out because he didn't have an actual medical practice that was damaged, just the prospect of a medical degree. Again, through a quirk in law, that doesn't count as being damaged. That just left the 1A allegations, which are proceeding.
