Here is how Erie Insurance Co addresses this

After each trip there is a screen that reports on your habits exhibited for that trip alone. There is an icon in the top corner that you tap on. It brings you to another screen where you can designate that you were a passenger and not the driver. The screen defaults every trip to scoring you as the driver. It works with your phone communicating with your car. So if you are inside the car while it's driven and your phone is turned on it will rate that drive. So if you aren't the driver you need to take the above steps and correct. Unless of course the person driving is a good one and thus earning you points :)
