I think it depends upon the state even if the violations are passed


onto the buyer. In doing a quick search it looks like in some states (I think AZ is one of them) a HOA can block a sale if the seller tries to pass HOA violations onto the buyer and the buyer is fully aware of the violations. It may also depend on the type of property being sold (i.e. condo vs. home).
