Expansion has to be unanimous until the current contract ends because

all parties are contractually bound to the current playoff system, ESPN and the conferences. I think if any of the conferences tried to unilaterally split off from the current structure, it would be a breach of contract. So even a split up would likely need to be unanimous until the current contract runs out or they would be risking a breach of contract lawsuit.

My prediction has always been that expansion won't happen until the current contract runs out in 2026 because of the great difficulty of getting all parties to agree on the terms of playoff expansion before that time. And I also don't think a P-5/G-5 split will happen before that time either due to the contractual messiness it would create.
