Exempt employees can do non-exempt work


It's only when it's all they do that there's a problem. Though that's when you're talking about the Fair Labor Standards Act since you're complaining to the NLRB is this a union thing? If so, it depends on what's collectively bargained. I would imagine there's a grievance procedure involved there, other than straight to the NLRB, isn't there?
