What say you Lounge Jurors. "Landowners Rights" or "Out of Control Judge"

Lots of ins and outs to this case. At what point does a landowner give up his rights?? I'm thinking about Red Cockaded Woodies-peckers and other protected species, Archeologic sites, artwork???? Interested in serious opinions but......pffft, this is the Lounge!
