It was below VFR mins before his initial takeoff, because he filed...


...a "Special VFR" flight plan. If the area had been clear, he would have filed a VFR flight plan. Heck, I don't know if I've ever filed one of those...maybe once or twice? Personally I would have filed IFR flight plan if the weather was that "marginal." There are too many towers and hills to try to fly under a low ceiling like that...
