Even if they wait until 2025, the Alliance will still need unanimous


support from the G5s. I say that because the structure of the organization in 2025 will remain exactly the same way it is now. There is the hyperlink for the College Football Playoffs LLC's goverance (aka the organization that runs the private entity that manages the FBS College Football Playoffs). If the Alliance tries to change the LLC's structure, then it will creep closer to violating antitrust laws and the attention of state and federal agencies (including politicians).

The reason I say the 5+1 could violate antitrust laws is because it places a constraint on G5's ability to trade (aka do business). The Sherman Antitrust Act of 1890 and its amendments is probably the antitrust law that will be cited the most if things enter the court system. The Sherman Act broadly prohibits 2 things:

1. anticompetitive agreements; and
2. unilateral conduct that monopolizes or attempts to monopolize the relevant market.

By only giving the G5s 1 automatic bid and the 5 P5s automatic bids even if the 5 G5 champions are ranked higher than the 5 P5 champions, then that would be a potential violation of #2. At least the P5s would have a difficult time supporting the argument that they have an "innocent monopoly" or a monopoly achieved solely by merit which is legal. Instead, the courts would likely see this as "acts by a monopolist to artificially preserve that status, or nefarious dealings to create a monopoly" which is illegal.
