It's not that big of an assumption when you look at the past rulings by

SCOTUS in cases involving the NCAA or NCAA members. If the power conferences weren't concern about violating antitrust laws, then they would have structured the CFP so that the 5 conferences would have received automatic bids from the start.

WRT the possibility of the power conferences forming their own division, it is a possibility. However, if they go that route then they better be prepared for the impact it will have on all the other sports they sponsor. At least I wouldn't assume the other DI schools or even all the DII and DIII schools will allow them to form their own division just for football and maybe basketball while remaining in a division with the other DI schools for all other sports. Don't forget there are some DII and DIII schools who currently compete at the DI level in those sports, so they will have a say in some of the DI matters. Yes, that notion sounds great for fans and message boards because football and men's basketball are the only sports that majority of the fans care about. However, all the NCAA schools will have to look at the big picture when they hash out how the new structure looks like. Plus, the power conference schools are only 65-69 schools and they may find themselves in the minority when it comes to a lot of the voting issues.
