I think your strawman is a leap, not what SCOTUS would do to it.


I don't think the next iteration of CFP will organize in a fashion that will violate antitrust laws; there is no compelling reason to do that. And yes, SCOTUS has (appropriately, imo) called the NCAA on the carpet. I don't think courts are going to cut anyone any slack.

But I also don't think they'll tell an organization how to conduct its own schedules and determine its own "champion"; I don't think they will tell a TV network what kind of content it has to show or how much it can pay for it; and I don't think they'll tell a pnp bowl who they can and cannot invite. Teams that aren't eligible for one competition are free to organize an alternate competition or event and sell it for whatever they can get. That's what ND is doing right now as an independent in football.

I think the sideboards for the future "P" level programs will be set to require a higher level of investment in programs/athletes than some schools are doing now and may not be comfortable doing in the future. For example, they may have to sponsor 20 varsity sports and provide monetary support for individual athletes at some minimum/maximum level.

I also think your last paragraph is spot on. It's a primary reason why the Alliance came together and why I think ND would consider joining. As has been said repeatedly on this board, ND has much more in common with the ACC, B1G, and PAC which on the whole have more extensive and diverse athletic programs than the SEC and Big 12. It's an extreme example but Michigan sponsors 27 varsity sports, 12 more than Alabama. Even Texas, which has the largest athletic budget in college sports, sponsors 20 programs...the same as VT and 5 fewer than UVA.
